Effective January 1, 2022 Illinois implemented a Birthday Rule for Medicare Supplement policyholders. This allows individual between ages 65-75 who have an existing Medicare Supplement (aka Medigap) policy to change their Medicare Supplement plan. This new rule allows the change without having to answer medical questions (aka medical underwriting). Policyholders have a 45 day enrollment window that starts on their birthday and they can change to an equal or lesser benefit plan. The new plan would also have to be with the same carrier.
For example, if a beneficiary has Medigap (aka Medicare Supplement) Plan F with “Company X” and their birthday was August 1 they would be eligible to enroll in plan G with “Company X” from 8-1 to 9-14. Outside of this window an application would require underwriting health questions unless a Guarantee Issue situation was present and the application could be denied due to the applicant’s health conditions.
